SWIMMER PARTY

THE PACT

NOBODYHAS TO LOSE.

Two things, written down where you can hold us to them: what we refuse to build, and how the money gets split when there finally is some. Both were easier to say now, before anyone is arguing about a number.

DRAFT v0.1 · DRAFT — NOT A CONTRACT

01PART ONE

WHAT WE WILL NOT BUILD

The first half of this page is a refusal. It comes first because it is the one that costs us money.

01

EVERY ACTOR IS ANIMATED

CG, drawn, obviously not a person. You can tell in a second, and you are supposed to. There is no roster tier where that stops being true.

02

NO PHOTOREAL PASS

Nobody here gets pushed toward real skin, real pores, real camera grain. Not as an upgrade, not as a premium tier, not for a client who asks nicely.

03

NO REAL PERSON'S FACE

We do not scan, lift, blend or approach a living person's likeness. Not a celebrity, not a stranger in a dataset, not a friend who said it was fine.

04

YOU CANNOT TAKE THEM THERE EITHER

The kit is free and almost everything is allowed. Converting one of these characters into something that reads as a real human being is the one thing that is not. That is not a remix; that is the thing we are here to not do.

WHY

It is not that photoreal is out of reach. It is that we are not going there.

A real actor has one thing we cannot copy: they walk into a room and a whole life walks in with them. Thirty-eight years of it. A divorce, a bad back, a father. That is not ours, and we are not going to go and take it.

Somebody will say we are leaving money on the table. We are. It is on a table we do not want to sit at — the one where the machine takes the actor's job and calls it progress.

Protecting that work is not charity. Anyone who makes things for a living is standing on the same floor. Pull it out from under actors this year and it is under all of us next year.

So we build the other thing. A character no human could play. A face that does not exist anywhere. A person who only works because somebody drew him that way. That is not a replacement for an actor. It is one more thing in the world.

ANIMATED CHARACTERS ONLY — NEVER A HUMAN LIKENESS

02PART TWO

HOW THE MONEY MOVES

The second half is a promise. Work should feed the people who did it. If a character breaks out, that money should not land in one account.

01

THE KIT IS FREE, PERMANENTLY

Every open kit stays free for non-commercial work, and we will not retroactively paywall one. If a kit ever moves behind a licence, the version you already downloaded keeps the terms it shipped with.

02

YOU BROUGHT THE JOB, YOU GET A CUT

If a brand reaches us because of your work with one of our actors, you are in the deal — not thanked in a reply. Target share for an introduced booking is a fixed percentage of the licence fee, agreed in writing before we sign anything.

03

YOU MADE THEM FAMOUS, YOU GET FIRST CALL

If a roster actor breaks out through your remix, you get first refusal on the official work that follows — direction, writing, voice, edit, whichever seat you actually want. Credited on the roster page, by name.

04

WE DO NOT SELL YOUR WORK

Your remix is yours. We will repost it and say who made it; we will never license it, bundle it into a pitch deck as our own, or train on it without asking you first, in writing, each time.

05

THE CHARACTER STAYS WITH THE HOUSE

The actor is the house's asset — that is what makes them worth building and worth protecting. What you make with them is yours outright. Nobody has to lose for the other to win, which is the entire point of writing this down.

WHAT IS SETTLED, WHAT IS NOT

This is a published position, not an executed contract. The settled lines are settled. The percentages are marked open on purpose — we will not print a number we have not honoured yet.
